The referee and the judge have found that the relator has successfully met this burden. Their findings of fact are binding upon us if they are supported by evidence. Lindsay v. Brawley, 226 N.C. 468, 38 S.E.2d 528; Thigpen v. Trust Co., 203 N.C. 291, 165 S.E., 720.
